Recent Update on Abortion Legalization in the US

Access to at-home abortion has been controversial for ages. While several states had relatively fewer restrictions on pregnancy termination, in others, it was the opposite. The laws regarding abortion have been going through changes time and again. And recently the US Supreme Court decided to overturn the existing 1973 Roe v. Wade law.

What is the Status of Legalization of Abortion in the US?

The overturning of the Roe v. Wade law will bring drastic legal repercussions, wherein half of the total states out of 50 may either restrict the access of females to pregnancy-ending options or ban it completely. Here is what the statistics are like:

  • The restriction will firstly affect 13 states where already the Supreme Court decision could trigger laws to take framework after the ruling is taken down.

  • As per a major abortion rights advocacy research group, this can be seen in states such as Kentucky, Missouri, Arkansas, Louisiana, Idaho, Tennessee, Oklahoma, Wyoming, South Dakota, and Utah.

  • The decision may spur a complete ban in some states, while in others, it may lead to outlawing pregnancy termination after 15 weeks or 6 weeks.

  • Now, it purely depends on the state as to how soon the trigger laws will bring a change in the restrictions or easing of laws.

We can expect the implementation of changed laws soon. For instance, the trigger laws in Arkansas will take an effect when the state attorney general shall authorize the overturning of Roe. Another example is Texas, where a blanket ban on pregnancy-ending procedures could reflect within 30 days of the Supreme Court’s call.

Things That May Take Place Henceforth:

Since women prefer the use of medicines in expelling pregnancy portions in the uterus, there has been a discussion on the validity of the abortion pills for the early pregnancy ending as well. States that may continue granting rights to the pills or invasive treatment, may establish more services to support pregnancy care for females in dire need. This may come with certain conditions such as parental consent, a limit for the gestation period, and others.

  •  The states where access to the pills could be legal are the Northeast and the West Coast (Oregon, Nevada, Washington, and California). The right to abortion is being pioneered in California by Governor Gavin Newsom, in the state’s constitution.

  • Ending a pregnancy will also remain legal perhaps in the Southwest and Midwest states such as Kansas, New Mexico, Minnesota, and Illinois.

  • Women may have difficulty getting abortion pills or invasive treatment for unwanted pregnancies in almost 26 US states, where a complete ban is possible on abortion. This will affect a large number of women in the Midwest and Southwest of the US and the nearby areas to receive healthcare support on the same.

  • The states that have passed legislation to widen and protect the reach of abortion care recently are Vermont, Maryland, Connecticut, New Jersey, and Colorado.

  • Women may have to travel distances to another state where abortion is legal, in case they cannot get the right or access to it in their region.

What About Legal Access to Abortion Pills on Prescriptions?

States that were already in the mood to restrict pregnancy termination services, will now take steps to stop people from purchasing the necessary medicines, which were otherwise available on the internet or telemedicine facilities. With the overturning of Roe v. Wade, the ban on pills may come into effect altogether. Till now 32 states have laws that permit physicians to provide abortion pills. Out of these, 6 states including Missouri and Texas, do not allow telemedicine service for the medication.

So, states that still have legal laws in place for the right to terminate the pregnancy, may allow women to buy pills online on prescription or telemedicine. Basically, two pills come at the foremost for the procedure – Mifepristone and Misoprostol. Mifepristone 200mg is taken orally with water on the first day, followed by the use of Misoprostol buccally or vaginally 24 to 48 hours later.

Here are some of the effects a woman may encounter for at-home abortion with pills:

  • Heavy vaginal bleeding from uterine contractions and associated cramps. Lower body pain especially in the lower abdomen, back, and legs.

  • Nausea, vomiting, diarrhoea, dizziness, and headache are some of the common side effects.

  • It can take up to a week or two for the pills to completely empty the uterus of the pregnancy tissues and the embryo.

Then there are 21 states who have certain terms that women have to maintain to get an abortion. Though there is no blanket bank here, females will have to attend one in-person visit with a physician rather than directly getting the medicines from the internet, mail, or telemedicine.

To Conclude

We are yet to see how the recent striking down of the Roe V. Wade law will bring a string of effects in the states regarding abortion care and services.
